Examples of negligence include: A driver who runs a stop sign causing an injury crash. A store owner who fails to put up a “Caution: Wet Floor” sign after mopping up a spill. A property owner who fails to replace rotten steps on a wooden porch that collapses and injures visiting guests.

A presumption that mens rea (‘guilty mind’) is required in criminal cases. Mens rea is one of the elements that has to be proved for a successful criminal prosecution. There is a common law rule that no one can be convicted of a crime unless it is shown they had the required intention to commit it.

Still, there are some clear differences. Criminal negligence requires someone to fail to know of a substantial and unjustifiable risk to be convicted. That same requirement doesn’t exist for civil negligence. Also, criminal negligence requires a gross deviation from a reasonable standard of care.

While negligence is usually not a crime, it can be considered criminal negligence under the right circumstances. Civil negligence is more common than criminal, but criminal negligence is much more severe and generally has much more damaging consequences.
