Established by Article I of the Constitution, the Legislative Branch consists of the House of Representatives and the Senate, which together form the United States Congress.

Article III, Section I states that “The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish.” Although the Constitution establishes the Supreme Court, it permits Congress to decide how to organize it.

“Justice delayed is justice denied” is a legal maxim meaning that if a legal remedy is available for a party that has suffered some injury, but is not forthcoming promptly, it is effectively the same as having no remedy at all.

It has several possible origins, one of which is the Magna Carta, clause 40 which reads “To no one will we sell, to no one will we refuse or delay, right or justice”. The case of Professor Cyril Karabus, detained in Dubai for the past five months, is an egregious example of justice delayed.

a) The hopelessly inadequate number of judges and also courts in the country is undoubtedly one of the major reasons for such delay. b) If the inadequate number of judges is one reason behind delay in judicial process another reason is the incompetence and inefficiency of judges.

Man is not made for law, but the law is for man. The expression “Access to justice” focuses on the following two basic purposes of the legal system: The system must provide access to all.

India has 14,576 judges as against the sanctioned strength of 17,641 including 630 High Court Judges. This works out to a ratio of 10.5 judges per million populations, Justice Rao said. The law states The Supreme Court can punish anyone who is found to indulge in contempt of the court.

This expression means that justice is impartial and objective. There is an allusion here to the Greek statue for justice, wearing a blindfold so as not to treat friends differently from strangers, or rich people better than the poor ones.

For example, atop the Old Bailey courthouse in London, a statue of Lady Justice stands without a blindfold; the courthouse brochures explain that this is because Lady Justice was originally not blindfolded, and because her “maidenly form” is supposed to guarantee her impartiality which renders the blindfold redundant.

Is justice blind? Not really. But justice suffers from a severe visual disease where the one color that affects what it sees is the color green, the color of money. Americans suffer from a justice system that harms the poor in an inordinate fashion.
