Can my uncle adopt me if I’m over 18?

HomeArticles, FAQCan my uncle adopt me if I’m over 18?

No. In the USA, adults can not be “adopted”. Your Aunt could possibly sponsor you, but you would need to go through the whole (legal) visa process, prove you can financially support yourself, etc.

Q. Can you adopt a relatives child?

You’ll obtain consent from the child’s parents, and/or the court will terminate their legal parental rights. You’ll petition the court to adopt your family member. You may have to complete any required home studies and submit any necessary documentation to verify that you’re prepared to parent this child.

Q. Can your uncle adopt you?

Your uncle can adopt you. You and both of your parents must consent. In the alternative, your uncle could ask the court to give him legal custody. That is probably sufficient to trigger eligibility for health insurance coverage for you.

Q. Can I get my stepdad to adopt me?

If you want to adopt a stepchild, you must have the consent (or agreement) of both your spouse and the child’s other parent (the noncustodial parent) unless that parent has abandoned the child. By giving his or her consent, the noncustodial parent gives up all rights and responsibilities, including child support.

Q. Do fathers have a say in adoption?

Not being married to the father doesn’t mean there are no birth father rights in adoption. Birth father adoption laws still apply. California requires that the father be notified of your pregnancy. An adoption attorney will serve the father with a Notice of Alleged Paternity.

After you obtain consent to terminate the parental rights of the other biological parent, you still may have to obtain your child’s consent in order to obtain stepparent adoption. In California, if your stepchild is twelve (12) years old or older, the child must consent to the stepparent adoption.

Q. What rights do the biological parents have?

As a biological parent of a child, you have the right to make decisions regarding the care and keeping of your child, so long as it does not jeopardize the health and safety of the child. Sometimes this includes the difficult decision to give your child up for adoption.
