In most situations, any child that is born in the United States or one of its territories will automatically receive American citizenship. It is still legal to travel to the United States on a tourist Visa to give birth provided that childbirth was not the sole purpose you applied for your Visa. Birth citizenship is still protected under the constitution for all individuals regardless of their nationality.

Note: While there are no rules prohibiting pregnant visitors from entering the United States, doing so to give birth is prohibited. A CBP officer will consider your pregnancy when deciding on your admission.

The safest time to fly during pregnancy is before 37 weeks or, if carrying twins, before 32 weeks, new advice says. The Royal College of Obstetricians and Gynaecologists says flying is not harmful during a low-risk pregnancy, but there may be side-effects.

If you are without complications, traveling up to 36 weeks by car or air is acceptable as long as you are aware of the potential risks. Complications such as hypertension, preterm labor, and premature rupture of membranes often come without warning and can occur quickly requiring medical attention.
